VPiX Terms and Sales Policy

This Sales Policy outlines the terms and conditions under which you agree to use the VPiX, MotorStreet, and CSI360 Software as a Service (SaaS) platforms, owned by Virtual Pictures Corp. Your use of any VPiX platform signifies your agreement to these terms. If you disagree, do not use our services.

1. Eligibility

Our services are available only to individuals 18 years and older. No part of our services is intended for children under 18.

2. Revision of Terms

We may revise these terms at any time. Updated terms will be posted with a new "Last Updated" date. Continued use after any changes constitutes acceptance.

3. International Users

We operate from the U.S. and comply with GDPR for international users. Dedicated servers may be hosted via Rackspace or Digital Ocean based on customer needs.

4. Service Description

Our on-demand 360 publishing platforms (vpix360.com, motorstreet360.com, csi360.net) allow you to create and publish 360 virtual tours. These platforms are leased through monthly or annual subscriptions and serve B2B mid-market and enterprise customers.

5. Third-Party Integrations

VPiX integrates with third-party services (e.g., Zillow, Facebook, vAuto). We are not responsible for the accuracy or continuity of third-party data. Month-to-month or non-VIP users may incur charges for support related to feed errors.

6. Hardware Sales and Return Policy

We do not offer refunds on cameras, lights, or studio gear. Pre-purchase demos via Zoom are available. Warranty-covered items will be repaired or replaced, but replacement coverage must be renewed separately.

7. Payments and Billing

You agree to pay all fees for products and services. We process payments via third-party vendors (QuickBooks Online, Shopify and, PayPal). We are not responsible for their policies or fees.

8. Special Projects Deposits and Cancellations

For custom-built-to-order products such as the MotorStreet 360 Carousel USA custom photo studios, we require a signed contract with a 50% deposit. Cancellations made to custom photo studios after fabrication begins will result in a 60% penalty. Custom order designs, programming and consulting, including but not necessarily limited to automotive edits for Homenet, vAuto and VDP integrations are non-cancellable.

9. Billing Disputes and Chargebacks

Disputes must be submitted within 30 days of a charge. Unauthorized chargebacks may result in legal action in El Paso County, Colorado.

10. SaaS Subscription Billing

Monthly plans bill on the 1st or 15th. Annual plans may be paid by check, credit card, or wire. National SLA contracts may pay monthly or annually.

11. Account Termination

Monthly Subscribers

Must submit cancellation at least 15 days prior to the next billing date.

Cancellations within 1-14 days will still incur the next billing charge.

Outstanding balances, including late fees, must be paid in full.

Customers must delete their own tours prior to cancellation. VPiX will not delete them to avoid liability or service disruption to the customer’s clients.

Failure to delete tours, access to services (training, support), continued use of VPiX-designed websites, or displaying VPiX-branded content will be considered continued use, and billing will resume until all projects are deleted and outstanding balances are cleared.

Annual Subscribers

Must submit cancellation at least 30 days prior to the renewal date.

Cancellation after that will still incur the annual fee.

12. Project Ownership and Transfers

Upon cancellation, projects remain hosted for 30 days. It is the account holder’s responsibility to notify clients and arrange for migration. VPiX will not be held liable for deleted content.

13. Custom Development and Training

All custom work is defined by a Scope of Work (SOW) and is non-refundable. Work-for-hire agreements transfer IP upon full payment. Boot Camps and Zoom training are non-refundable but may be rescheduled in cases of internet or network issues.

14. Photographer and Drone Services

All jobs require a signed SOW and shot list. If not provided, the customer assumes responsibility for the outcome. Post-production is billed separately.

15. Abandonment and Financial Negligence

Failure to pay or cancel properly is not acceptable. Accounts in arrears over 60 days may result in VPiX transferring your projects to clients or other providers. Copyrights may be reassigned.

16. Content Representation

You certify all uploaded content is yours, licensed to you, and not offensive or infringing.

17. Indemnification

You agree to indemnify VPiX for any claims arising from your content, projects, or misuse of the platform.

18. Pricing, Quotes, and Shipping

Quotes are valid through their expiration date. U.S. and international shipping may include additional fees. All shipments are insured. Inspect deliveries within 2 business days.

19. Government, Military, and Law Enforcement Pricing

Price locks require a signed quote and PO for 6+ months.

20. Licensing and DFARS Compliance
